The General Conditions of Use govern the use of the various areas of the Conency website, hereinafter referred to as “the Site”.
Conency is committed to respecting the privacy and rights of its users. We do not sell or transmit personal information, except as necessary to provide the services outlined herein, in accordance with our Privacy Policy.
Conency provides services to two user types:
1. Customers: Companies or firms seeking consultants or who have engaged consultants’ services (hereinafter referred to as “Customers”).
2. Consultants: Freelancers or independent professionals providing services (hereinafter referred to as “Consultants”). Becoming a consultant, who can be found on this platform is only possible after passing a rigorous evaluation process based on Customer feedback.
By using the platform, all users (whether Customers or Consultants) agree to these General Terms of Use (hereinafter “Terms”), which govern the access to and use of the Conency platform and services. By accessing or using the platform, users accept these Terms in full.
In these Terms, the following definitions apply:
– Feedback: Opinions or evaluations provided by Customers regarding a Consultant’s services.
– User: Any individual or entity using the Conency platform, including both Customers and Consultants.
– Data: All information, including identification data, provided by Users in connection with the service.
– Conency Network: All Consultants listed and accessible on the platform.
– Service: The features and services provided by Conency on the platform.
1. Eligibility: By accepting these Terms, Users confirm that they are at least 18 years old or have obtained parental consent if under the age of 18. Parental authority holders agree to be responsible for ensuring minors’ compliance with these Terms and monitor their use of the platform.
2. Modification: Conency reserves the right to modify, suspend, or terminate the Service or certain features at any time, with prior notice where possible.
3. User Discretion: Users may suspend or terminate their use of the Service at any time, without prior notice to Conency.
4. Subscription Renewal and Refund Policy: Your subscription will automatically renewed at the end of each billing cycle unless you cancel it in accordance with the cancellation terms provided. Please note that all payments are non-refundable, and no refunds will be issued for any reason, including but not limited to early termination or unused portions of the subscription period.
By using the platform, Users agree to:
1. Be contacted by Conency through permitted means (e.g., Email, SMS, Telephone) for service-related communications and feedback requests, in accordance with the Privacy Policy.
2. Submit accurate and lawful Feedback about their experience, ensuring the feedback adheres to objective standards, does not infringe third-party rights, and is not defamatory, discriminatory, or otherwise unlawful. The User shall not attempt to mislead third parties by impersonating the name or company name of others, and in particular by impersonating an employee of Conency.
3. Not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, software, products, services or benefits obtained from the Site, except with the express written permission of Conency.
4. Refrain from submitting Feedback on themselves, family members, or entities with whom they have a personal connection.
5. Avoid any illegal activity, including but not limited to impersonation, infringement of intellectual property rights, and dissemination of prohibited content (e.g., offensive, discriminatory, or defamatory material).
6. Not use the platform for unauthorized commercial purposes, competitive analysis, or data extraction without prior written consent from Conency.
To ensure the authenticity and integrity of Feedback:
1. Each Feedback is reviewed by Conency staff, who may use tools to verify its authenticity. Afterwards, the Feedback will be published within 2 weeks.
2. Conency may contact the Consultant and/or User to verify that the feedback corresponds to an actual transaction. Feedback on services provided more than two (2) years ago will not be published.
3. For any publication, Conency shall verify that the Feedback has indeed been made with respect. Conency reserves the right to moderate and correct Feedback for the following purposes:
Ensuring compliance with legal standards
Addressing formatting issues (e.g., excessive punctuation or capitalization)
Removing personal attacks or defamatory content
4. Consultants have the right to respond to Feedback either through the platform or by contacting Conency. Any dispute will be discussed and mitigated between the User and the Consultant.
The platform’s core services are offered free of charge. However, Conency reserves the right to introduce paid services, with prior notice and clear disclosure of applicable tariffs.
1. User Rights: Users retain full ownership of their Feedback and other content they post on the platform. By posting Feedback, Users grant Conency a non-exclusive, worldwide, royalty-free license to reproduce, distribute, and display such Feedback for purposes related to the platform’s operation and promotion.
2. Consultant Obligations: Consultants are prohibited from reproducing or using Feedback without Conency’s prior consent.
1. Accuracy: Users must provide accurate, current, and complete information. Conency is not liable for damages arising from false or misleading information submitted by Users.
2. Content Liability: Users are solely responsible for the content they provide. By using the platform, Users waive claims related to potential damages to their reputation or privacy resulting from the disclosure of information they voluntarily provide.
3. Data Handling: The handling of personal data is governed by Conency’s Privacy Policy, in compliance with applicable data protection laws (including GDPR).
1. Service Quality: Conency strives to ensure the availability and reliability of the platform but does not guarantee continuous service. Conency is not responsible for unauthorized use of Feedback.
2. Liability Limitation: Conency disclaims liability for third-party services or Consultants’ work, including the accuracy of estimates, invoices, or qualifications. Conency’s role is limited to providing an intermediary platform.
3. Disputes: In case of disputes, the responsibility lies with Users and Consultants to resolve issues. Conency may moderate communications but is not responsible for settling disputes.
Users may report content that violates these Terms through the platform’s “contact us” feature. All reports are subject to review and appropriate action, including content removal.
Conency has set up a system that is easily accessible and visible to all, allowing Users of the Service to bring to its attention, via the “I report abuse” alert. Exchanges on the Service are subject to a posteriori moderation. This moderation makes it possible to reject without notice any message which would not respect the provisions mentioned in Article 4 hereof.
Conency respects consumer rights and data protection regulations. Users are not subject to commercial canvassing.
Conency retains all rights to its brand, logo, platform, and associated intellectual property. Users are prohibited from reproducing or distributing Conency’s content without prior written consent.
Neither party shall be held liable for non-performance of its obligations if such non-performance is caused by a force majeure event, including but not limited to natural disasters, major technical disruptions, or other unforeseen circumstances beyond the party’s reasonable control.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
These Terms are governed by French law. Any disputes between Conency and a Consultant or Customer will be subject to the jurisdiction of the Commercial Court of Grenoble.
A violation of these General Conditions may result in exclusion from the network.
